1. Seller Identity
BlackPeak Trading is operated by BlackPeak Trading, a private individual trading under the name BlackPeak Trading, based in Estonia, European Union. Contact: blackpeaktrading@mail.ee
2. Product Description
BlackPeak Trading sells proprietary Expert Advisor (EA) software files (.ex5 format) designed for use with the MetaTrader 5 trading platform. The software is provided as a digital download and is intended for use on the US100 (Nasdaq 100) instrument. Three tiers are available: BlackPeak Lite, BlackPeak Standard, and BlackPeak Pro, each differing in the range of trading signals enabled.
The software is a tool. It does not constitute financial advice, investment advice, or a managed investment service. Past performance of the software in demo or live conditions does not guarantee future results. Trading financial instruments involves significant risk of loss.
3. Price and Payment
All prices are displayed in Euros (EUR). Payment is accepted in cryptocurrency (Bitcoin, Ethereum, Litecoin) only. Prices displayed on the website are inclusive of any applicable taxes unless otherwise stated. The exact cryptocurrency amount to be sent is calculated at the time of checkout using live exchange rates and may fluctuate. The buyer is responsible for sending the correct amount to the correct wallet address.
BlackPeak Trading is not responsible for funds sent to incorrect addresses or amounts sent in error. Cryptocurrency transactions are irreversible.
4. Delivery
Upon payment verification, the purchased .ex5 software file and setup guide will be delivered to the buyer's provided email address within 24 hours. Delivery is made electronically. BlackPeak Trading will make reasonable efforts to deliver within this timeframe but cannot guarantee delivery in cases of technical failure, incorrect email address provided by the buyer, or circumstances beyond our control.
5. No Refund Policy — Digital Goods
This product is a digital good. Under EU Directive 2011/83/EU Article 16(m), the right of withdrawal does not apply to digital content that has been delivered, where delivery began with the consumer's prior express consent and acknowledgement that they thereby lose their right of withdrawal.
By completing your purchase, you expressly consent to immediate delivery of the digital product upon payment verification and acknowledge that you waive your 14-day right of withdrawal once the file has been delivered to your email address.
No refunds will be issued after delivery of the digital file. If you have not received your file within 24 hours of payment verification, contact us at blackpeaktrading@mail.ee and we will resolve the delivery issue.
If payment is made but the transaction cannot be verified after reasonable investigation, a full refund in the same cryptocurrency will be issued within 14 days.
6. Licence
Upon purchase you are granted a personal, non-exclusive, non-transferable licence to use the software on up to two MetaTrader 5 accounts simultaneously. You may not resell, redistribute, reverse-engineer, decompile, or share the software with third parties. "Lifetime access" means access for the commercial lifetime of the product. BlackPeak Trading reserves the right to discontinue the product with 90 days' notice, during which no further updates will be issued but existing files will remain functional.
"All future updates included" refers to updates to the same software tier purchased (bug fixes, parameter adjustments, strategy refinements). It does not include entirely new products or major version releases that represent a materially different product.
7. Risk Disclaimer
Trading financial instruments, including indices such as the Nasdaq 100, involves substantial risk of loss and is not suitable for all investors. The use of automated trading software does not eliminate risk. Past performance shown on this website was achieved under demo account conditions and does not guarantee identical results on live accounts. You may lose some or all of your invested capital. Only trade with capital you can afford to lose. BlackPeak Trading accepts no liability for trading losses incurred through the use of this software.
The software relies on MetaTrader 5 being connected and operational. Internet disconnections, broker outages, platform crashes, or extreme market conditions (including but not limited to gap opens, flash crashes, and illiquid conditions) may prevent automated stop-loss execution. BlackPeak Trading accepts no liability for losses arising from such events.
8. Compatibility
The software is designed for use on MetaTrader 5 on the US100 (Nasdaq 100) instrument. Compatibility with specific brokers or prop firms is not guaranteed. The buyer is solely responsible for verifying that automated trading is permitted by their broker and prop firm before use. BlackPeak Trading accepts no liability for account violations, suspensions, or losses arising from use of the software on a prop firm account.
9. Limitation of Liability
To the maximum extent permitted by applicable law, BlackPeak Trading's total liability to you for any claim arising from your purchase or use of the software shall not exceed the amount you paid for the software. BlackPeak Trading shall not be liable for any indirect, consequential, special, or incidental damages including but not limited to lost profits or trading losses.
10. Governing Law
These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be subject to the jurisdiction of the Estonian courts. If you are a consumer in another EU member state, you retain the right to bring proceedings in the courts of your country of residence.
